Preamble
Hosting terms between Sebistar.net Hosting Services and the Anphillia Online Roleplaying Game.
The following document defines the guaranteed rights, privileges, and guidelines that which shall bind the Anphillia Online Roleplaying Game (henceforth referred to as Anphillia) and Sebistar.net Hosting Services (henceforth referred to as sebistar.net) into a mutually accepted agreement.
Definitions
Forward "good faith" rules:
1. Thou shalt not be excessively annoying.
2. Thou shalt not be easily annoyed.
Definitions:
Service - A physical machine with hardware and software capable of doing its assigned task. It includes the administrative realm of the operating system, the hardware it runs on, and the internet connection it is supplied.
Game - A piece of software which will run on the Service. It includes its players, DMs, and any other role available for it, as well as any intellectual property created or acquired.
Rights of the Host
1. The host has sole responsibility over the hardware and software running on this Service.
2. The host has no responsibility over the content of the data running on this Service, to the extent allowed by law.
Two exceptions to this are as follows:
a. The host is responsible if the Service is used to distribute illegal materials.
b. The host is responsible if the Service is used to cause slander or libel against an individual.
If at any time the host finds that the content fits the description of any exception, the host has the right to remove the content without notice or permission.
3. The host may propose an amendment to this agreement as covered below under the "Making an Amendment" section.
4. The host may terminate the Service with a one-week notice. The host will agree to provide the Service for a minimum of 1 week after termination, with it's hosting agreement in tact.
5. The host will not be harassed by any user of the Service to provide further services, to change the operation of the Service, or to change the operation of any part of the hardware or software that the Service uses.
6. The host will be allowed to use the Service, providing that the host agrees to all conditions any normal user would be subjected to for using the Service.
7. The host may temporarily interrupt the Service for routine maintenance or emergency upgrades. The host will attempt to provide as much advance warning as possible.
Rights of the Client
1. The client will not be harassed by the host to alter the content or operations of the Game
2. The client shall be represented by an unlimited number of administrative users appointed by whatever means the client chooses. These administrative users will be considered the delegates to the host.
3. In any matter of conflict of interest, the host, if participating in any Client matters, will abstain from participating in Client-Host actions as a member of the client's community, and act only as host.
4. The client may propose an amendment to this agreement as covered below under the "Making an Amendment" section.
5. The client may terminate the Service at any time, no notice is required. At this time the host will surrender all property which is considered owned by the client or the game immediately.
6. The client may request that any data that is not the direct intellectual property of the host be surrendered or duplicated at any time (within the limits of the law), with the understanding that if the data is surrendered it may cause an interruption in the provided Service due to software failure.
Amending the Agreement
Definitions:
Submitting Party: The party responsible (either Client or Host) for creating the proposed amendment.
Receiving Party: The party (either Client or Host) receiving the amendment from the Submitting Party.
1. The amendment must be submitted in a forum by which both the Submitting Party and Receiving Party are able to communicate.
2. The Submitting Party has the right to have their amendment heard by the Receiving Party.
3. The Receiving Party will reply in a timely manner.
4. The Receiving Party may reject or accept the amendment.
5. If rejected, the amendment may be reproposed immediately, but not to be excessively annoying in accordance with the "good faith" rules.
6. If accepted, then the amendment is considered immediately to be part of the Hosting Agreement.
7. All amendments must be documented as footnotes from the original agreement for historical purposes for it's "official" version, but may be abbreviated as a "current set" for reference.
